Abstract

LGBTQIA+ Rights: A study on the use of judicialization by the Matizes Group in Brazil

The article presents judicialization as a working strategy of the Matizes Group, one of the main LGBTQIA+ social movements in Brazil. The question that guided the research was the following: what strategies are the LGBTQIA+ social movements using to guarantee rights and why the option for judicialization? To answer this question, a quantitative and qualitative research study examined the cases brought before the courts by LGBTQIA+ social movements and the judicialized demands. Four interviews were also conducted with members of the Matizes Group. We show that, in the absence of approval of rights by the Brazilian legislative power, judicialization became part of these social movements’ strategies.
